Abstract

This research discusses the Inter-American System and direct access to the IACHR (InterAmerican Court of Human Rights) by individuals, with a view to further promoting the International Human Rights Law in America. In this context, this research also addresses issues related to access to justice and Supranational Human Rights Courts with a particular emphasis on the individual (as a direct petitioner). The structuring of the Organization of American States is an important subject. Also, the research seeks to understand in depth the systems of both the Inter-American Court and the European International Court of Human Rights – a worldwide reference in this matter – through a comparative study. The direct access (by the individual) to the IACHR is still a proposal. The general objective of this research consists in understanding the Inter-American System in the matter of direct access by the individual to the jurisdiction of the IACHR – an important institution for the promotion of International Human Rights Law in the American continent, as well as in the Caribbean region. The specific objectives are: to address the access to justice and the access to international courts (supranational courts) from the perspective of the individual (as an international right-holder); to focus on the InterAmerican System, the importance of its Commission and its Court; and, finally, raise awareness on the importance of direct access to the Human Rights Court (by the individual), which necessarily requires a comparative analysis with the European Court. The applied methodology consists of bibliographic research and deductive logical method from doctrinal sources of Applied Social Sciences, especially international law. The conclusion is that direct access to the IACHR by individuals is important to promote international human rights law in the American continent, as well as to grant the individual a right-holder status and exalting the protection of his dignity.
